What’s said in a courtroom matters, not just during the trial, but afterward. Imagine what would happen if judges couldn’t go back and review cases in full because those cases existed for only a brief moment in time, turning to nothing but a note of the verdict afterward. To preserve courtroom contents, people have been keeping an official record for hundreds, if not thousands, of years.
However, this process has not always looked the same. What began with scribes soon developed into shorthand systems and stenography. Nowadays, we have digital audio and video recordings. Each of these jumps accomplished a lot for the court, but they also came with challenges: worker labor, skill refinement, accuracy, and more.
How Court Transcription Started
Long before the modern concept of “recording” a trial, legal proceedings were documented by scribes. This practice was common in Egypt, Rome, and Mesopotamia, though legal systems developing throughout later Europe increasingly relied on clerks for the same purpose.
Even in the modern day, people cannot typically write at the same pace as natural speech. Add the complication of a quill and ink, and it is easy to see why scribal transcription was a slow, painstaking process. As a result, scribes frequently recorded only a summary of the testimony as they understood it. Important statements might be quoted directly, but the rest of the record was usually the scribe’s own overview.
For the time period, this method worked. The purpose was merely to document judgments, and processes such as appeals either didn’t exist or didn’t occur regularly enough to warrant more detail. However, this approach could significantly impact an account’s accuracy. Two scribes could choose very different elements to highlight, mishear elements, or summarize them differently based on their own understanding. As appellate courts developed with the need to review for errors, this process became a growing concern.
The Growth of Transcription: The Birth of Stenographers
As court proceedings became faster and longer, the demand for verbatim records grew, and this is where shorthand came from. The need for increased accuracy prompted the development of shorthand systems, such as Pitman’s and later Gregg’s for professional transcription. Rather than writing every word, stenographers (shorthand writers) used specialized symbols that represented sounds or meanings. This allowed them to write several times faster than conventional handwriting.
This process was revolutionized further with the invention of the stenotype machine. Instead of writing on paper by hand, stenographers pressed multiple keys simultaneously to produce phonetic combinations. This keyboard dramatically increased writing speed, and skilled stenographers could capture testimony in real time, even from fast talkers or non-native speakers. Suddenly, stenography was a highly coveted professional skill.
Compared to scribal transcription, stenographers massively increased the reliability of court records. Experienced court reporters could routinely achieve accuracy rates of 95% or more, and those transcripts would be proofread and verified to fix lingering errors. However, this evolution did not come without challenges. Anyone who could write could become a scribe in short order. But using a stenotype machine, and using it well, took years of specialized training. Staffing shortages were common as a result. The only thing less accurate than a scribal-summarized transcription is a completely absent one because no court reporter was available.
Modern-Day Record-Keeping in Court
Nowadays, modern technology has further changed the court transcription landscape. Many courts now use digital and/or audio recordings to capture every event. While written transcriptions can be requested and made after the fact for appeals or other needs, the case doesn’t necessarily need a stenographer present anymore.
Digital recording systems offer information that no other method could. They preserve the tone and timing of speech, allow viewers to understand facial expressions and gestures, and overcome the difficulty of staffing that was formerly common with stenographers. However, even technologically advanced systems such as these are not foolproof. If microphones are not placed and maintained properly, they could fail to capture speech accurately. Technical malfunctions (which may not be noticed) can interfere, and when speakers overlap, the entire exchange can become difficult to parse. Unlike an in-person court reporter, a recording system can’t ask witnesses to repeat their answers or request that attorneys stop talking over each other.
For these reasons, many legal professionals recommend that both digital and human recording be used complementarily rather than in isolation. Although humans have struggled to keep pace with speech accurately, they are still invaluable as the final line of defense when accuracy matters.
